Terms of Service for AI Game Generator

1. Introduction & Acceptance

These Terms of Service (“Terms”) govern access to and use of AI Game Generator, our website at ai-game-generator.com, dashboards, APIs, and related services (collectively, the “Services”). By creating an account, purchasing credits, or using any part of the Services you agree to these Terms and to our Privacy Policy. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Description of the Services

AI Game Generator provides tooling to:

• Convert user prompts into playable HTML5 games.
• Run AI intent analysis, manage prebuilt game templates, and export code.
• Handle credit-based billing, analytics integrations, and optional third-party provider connections.

We may enhance, add, or remove features at any time. Certain features may be in beta and provided on an experimental basis.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to form a binding contract. You must comply with all applicable laws, including export control and sanctions regulations, when using the Services.

4. Accounts & Security

1. Registration: Provide accurate, current, and complete information when creating an account. You agree to update details as needed.
2. Credentials: Safeguard your login credentials and do not share them with unauthorised parties. You are responsible for all activity that occurs under your account.
3. Security Incidents: Notify us immediately at [email protected] if you suspect unauthorised access or account compromise.

5. Credits, Pricing & Payments

• The Services operate on a credit system. Credits are required for custom AI generations and other metered features. Preset previews may be free or consume fewer credits at our discretion.
• Credit purchases are billed through Creem today. Additional payment processors may be added in the future and will be announced in advance.
• Unless otherwise stated, all sales are final. We may provide refunds or credit adjustments at our sole discretion or where required by law.
• Prices are subject to change with notice. Ongoing use after price updates constitutes acceptance.
• Credits may expire as stated at purchase or in your dashboard; expired credits are non-refundable.
• You may cancel subscriptions at any time from the dashboard by opening the Manage Subscription link in the Billing section, which redirects to the Creem customer portal. If you need assistance, email [email protected] and we respond within 3 business days.

6. Ownership & Licences

• Your Content: You retain all rights to prompts, assets, generated HTML5 games, and other materials you upload (“Customer Content”). You grant us a limited licence to store, process, and display Customer Content solely to provide the Services.
• Generated Games: You own the HTML/JS/CSS output created for you, subject to third-party licence requirements (e.g. game assets or fonts you supply).
• Service IP: We retain all rights to the AI Game Generator platform, documentation, templates, and code that enable the Services. No rights are transferred except those explicitly granted in these Terms.

7. Acceptable Use

You agree not to:

• Use the Services to create or distribute unlawful, discriminatory, infringing, or harmful content.
• Reverse engineer, decompile, or attempt to derive source code (except to the extent permitted by open-source licences).
• Resell, sublicense, or provide the Services to third parties without a separate written agreement.
• Interfere with the integrity or performance of the Services or attempt unauthorised access to accounts, systems, or networks.
• Abuse credits, run load tests, or perform automated scraping without prior consent.

We may suspend or terminate accounts for violations of this section.

8. Third-Party Integrations & AI Providers

The Services run on AI infrastructure that we operate and manage. If we later enable integrations with external model providers, you authorise us to transmit prompts and related data to those services under their respective terms. We are not liable for delays, errors, or policy decisions made by any third-party provider.

AI Game Generator is an independent product. We are not affiliated with, endorsed by, or sponsored by any third-party AI model provider. Any reference to external services is for descriptive purposes only.

9. Privacy

Our data practices are described in the Privacy Policy. By using the Services, you consent to our collection and processing of information in accordance with that policy.

10. Confidentiality

Each party agrees to protect the other party’s confidential information using at least reasonable care and only use it for purposes related to these Terms. Confidential information excludes data that is public, already known, independently developed, or lawfully obtained from third parties without restrictions.

11. Beta Features

We may label certain features as “beta”, “preview”, or similar. Beta features are provided for evaluation without service-level commitments and may be discontinued at any time. You use beta features at your own risk.

12. Disclaimers

The Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, or that generated games will meet your specific requirements.

13. Limitation of Liability

To the fullest extent permitted by law:

• AI Game Generator and its affiliates shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill.
• Our total cumulative liability for any claim related to the Services will not exceed the amounts you paid to us for the Services in the 12 months preceding the event giving rise to liability.

These limitations apply even if we have been advised of the possibility of such damages and regardless of the legal theory.

14. Indemnification

You agree to defend, indemnify, and hold harmless AI Game Generator, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your Customer Content, your use of the Services, or any breach of these Terms.

15. Term, Suspension & Termination

These Terms remain in effect until terminated. We may suspend or terminate your access immediately if you breach the Terms, violate applicable laws, or create risk for other users. You may close your account at any time via the dashboard or by contacting support. Section provisions that by their nature should survive termination (e.g. ownership, indemnity, limitations of liability) will remain in effect.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, USA, excluding its conflict-of-law rules. Any dispute that cannot be resolved informally will be submitted to binding arbitration in San Francisco County, California, under the rules of the American Arbitration Association. Each party waives the right to a jury trial or to participate in class actions, though you may still seek relief in small claims court for eligible disputes.

17. Changes to the Terms

We may revise these Terms to reflect changes in functionality, legal requirements, or business practices. Material changes will be announced via email or in-app notices before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
